I hereby represent that I am a Veteran of the Canadian Armed Forces (defined as any former member of the Canadian Armed Forces who successfully underwent basic training and is honourably discharged) and/or a former serving member of the Royal Canadian Mounted Police, and/or a Family member (defined as a person who is related either biologically, emotionally or legally, taking into account whom the Veteran identifies as significant to their mental well-being) of a Veteran of the Canadian Armed Forces or former serving member of the Royal Canadian Mounted Police. I am submitting this with the understanding that it will be relied upon to determine my eligibility in the Contest.
I acknowledge that, as a result of my participation in the Contest conducted by the Atlas Institute for Veterans and Families (Atlas Institute, formerly operating as the Centre of Excellence on Post-Traumatic Stress Disorder and Related Mental Health Conditions), I have been selected as a Contest winner and will receive a prize (the “Prize”).
I acknowledge and confirm that: (a) I accept the Prize as awarded; (b) I shall be responsible for any expense not specifically described as included in the Prize; (c) I shall not receive any additional compensation for my appearance, performance and/or participation in the Contest, or for any rights granted to the Atlas Institute or others as set out herein; and (d) the Atlas Institute is not responsible or liable for, any warranty, representation or guarantee, express or implied, related in any way to the Contest and/or the Prize.
I affirm and represent that I have complied with all the rules and regulations of the Contest and that I have committed no fraud or deception in entering the Contest or in claiming any prize. I represent that I have obtained my materials through authorized, legitimate channels. I further represent that I am not an employee of the Atlas Institute, or of any other entity stated in the official Contest Rules whose employees are not eligible to enter the Contest or a member of the Family or household of any such employee or agent.
I understand that I am entitled to receive only the announced prize and that prizes are non-transferrable, and no substitutions will be made.
I hereby irrevocably release, forever discharge and indemnify the Atlas Institute, including its directors, employees and volunteers, from and against any and all claims, losses, liabilities, costs, damages, actions, judgments, obligations, penalties, and expenses of any kind or nature whatsoever (including legal fees) in any way arising directly or indirectly in whole or in part out of any injury, loss, or damage that the undersigned may suffer in connection with my participation in the Contest or any Contest-related activity, and/or my acceptance, use, or misuse of the Prize; any breach of the Contest Rules by the undersigned; the conduct of the Contest; the operation of the website through which entrants may submit entries to the Contest; any alternate method of entering the Contest; or any third party claims in relation to the Contest.
I acknowledge and confirm that: (a) I have read, understood and complied with the Contest Rules, attached hereto; (b) I have read, understood and agree to the terms and conditions of this confirmation and release, which shall be binding on me and my heirs, executors, administrators, representatives, successors and assigns; and (c) the Atlas Institute has the right to terminate the Contest, in whole or in part, or modify, amend or suspend the Contest, the Prize and/or the Contest rules in any way at any time for any reason without prior notice or compensation to me.
I hereby authorize the Atlas Institute to use my name, title, and any content (text, images, audio recordings and/or video footage which might contain remarks, or commentary which reflect participation) taken of myself, in whole or in part, individually or in conjunction with other materials in relation to the above-named Contest. It is understood that there are various options available to me for varying my level of anonymity, should I so choose.
If I wish to modify my decision regarding any level of consent provided in the above paragraph, I will contact media-atlas@theroyal.ca with my request. I understand that upon notification, the Atlas Institute will remove my images/video from its website, social media channels, and other materials that are within its control. I acknowledge that while I will have the opportunity to review and approve content related to my participation that once my information, video(s) or photo(s) are shared in print publication(s), on website(s) other than that of the Atlas Institute, or on social media, it becomes public knowledge and will no longer be protected. My images/video may still be visible on the Internet even after it has been removed from the Atlas Institute’s channels. As such, other people or organizations who accessed and viewed it might also use or share it.
I am providing information, including stories, or accounts of information, to the Atlas Institute in the expectation that such information may ultimately be published by the Atlas Institute on its website, or through another medium such as through social platforms, including Vimeo or YouTube channels. I understand and agree that in providing such information that I may not knowingly provide untruthful information, or defame or disparage any individual or organization, or use the occasion of providing information to the Atlas Institute for the purpose of injuring or causing damage, directly or indirectly, to any person or individual. Therefore, I agree that I will not knowingly provide false, untrue or misleading information to the Atlas Institute. I warrant and represent that all the information that I may provide to the Atlas Institute will be, to the best of my knowledge, full, truthful and entirely accurate. I understand that the Atlas Institute is not in a position to investigate or verify the information I may provide and accordingly, that it is entirely reasonable for the Atlas Institute to rely on my assurances as contained in this agreement that all of the information I may provide will be true, full and accurate to the best of my knowledge. I will not at any time assert or claim that the Atlas Institute had any duty or responsibility to investigate the information that I provide. I accept full and complete responsibility for the information that I may provide, including any responsibility arising from the publication of it.
I agree that I will hold the Atlas Institute and its officers, directors, employees and agents (collectively, the “Indemnified Parties”), harmless from and against any and all liability, costs, damages or injury arising from the publication of any information I provide. I hereby fully release the Atlas Institute and its respective directors, employees, and volunteers from any and all liabilities, demands, debts, actions and causes of action whatsoever, including without limitation, any claims based on the negligence of the Atlas Institute, or any privacy-based claims, which I, at any time, had or in the future may have as a result of my participation in this Contest, the provision of information by me and or the handling, disclosure (accidental or otherwise) or publication of such information by the Atlas Institute.
My name, images and/or audio-visual footage which might contain remarks or commentary which reflect participation may be displayed on the Atlas Institute’s website and other official channels, and may be used for promotional purposes such as marketing and social media campaigns. The Atlas Institute shall be the sole owner of such materials and information. The Atlas Institute may remove any material provided by me from its website in its sole and absolute discretion with or without my consent. Nothing contained in this agreement, or in any dealing between myself and the Atlas Institute will amount to an assurance or representation that the Atlas Institute will publish the information I provide to it.
If the participant has not reached the age of majority, a parent or guardian hereby gives their permission to the Atlas Institute to use the name, title and any images, audio recordings and video footage as outlined above.
